Introduction
By browsing, registering, or placing orders through the Sit Habayib platform, you acknowledge and agree to be fully bound by these Terms and Conditions, which constitute a legally binding agreement between you and the Sit Habayib platform.
If you do not agree to any of these terms, please refrain from using the platform.
 
 
 
Modification of Terms and Conditions 
Sit Habayib reserves the right to modify, update, add, or remove any part of these Terms and Conditions at any time without prior notice. Any changes will become effective immediately upon being posted on the platform. You are encouraged to review this page regularly, as your continued use of the platform after any modifications constitutes your implicit acceptance of the updated terms.
 
 
 
About Us
Sit Habayib is an e-commerce platform dedicated to empowering Omani women by providing an integrated digital space to showcase and sell their homemade food and beverage products. The platform embodies a modern shopping concept that blends authenticity with innovation, offering home-based producers an opportunity to reach a wider customer base with reduced operational costs—making the growth of their business more accessible and sustainable.
 
 
 
Agreement Acceptance
By registering on the platform or using any of its services, you acknowledge that you have read, understood, and fully agreed to be bound by these Terms and Conditions. This agreement constitutes a legally binding contract between you and Sit Habayib.
You are responsible for all activities carried out through your account and must ensure that anyone accessing the platform through your account complies with these terms. If you do not agree to these Terms of Use, you are not permitted to use the platform.
These Terms and Conditions apply to the Sit Habayib platform and all of its applications on iPhone, iPad, Android devices, and mobile browsers.
 
 
 
 
 
Description of Services Provided on the Platform
The Sit Habayib platform allows users to browse and order homemade products offered by registered home-based producers. Users can make electronic payments and receive their orders in accordance with the procedures in place.
 
 
 
Terms of Platform Use

  • Users must be at least 13 years old to use the platform.
  • The platform must not be used for any illegal, abusive, or misleading purposes.
  • Users are required to provide accurate information during registration or when placing an order.
  • The platform, or any part of it, may not be used for commercial purposes without prior written permission from the platform's management.

 
Order Placement and Execution Procedure

  1. When you select a product from the list of sellers displayed on the platform, you can place your order by clicking the "Place Order" button.
  2. Please ensure that you carefully review all entered information and correct any errors before confirming the order, as clicking this button constitutes your final approval and the order cannot be modified or canceled afterward except in accordance with the approved cancellation policy.
  3. Once we receive your order, Sit Habayib platform will begin processing it, and a confirmation message will appear on the final page indicating that your order has been successfully received and sent to the seller.
  4. If an unauthorized payment method is used or the payment process fails, you will be redirected to the previous page, and the platform will not be obligated to process the order or provide any services until the payment method is corrected.

 
 
Relationship Between User and Seller

  1. All products displayed on the Sit Habayib platform are produced and offered by productive families (hereinafter referred to as “sellers”), who bear full responsibility for the quality, safety, and composition of their products in accordance with the laws and regulations applicable in the Sultanate of Oman, especially those related to food safety and health.
  2. Sit Habayib acts as a digital intermediary between users (customers) and sellers, limiting its responsibility to providing the digital infrastructure and facilitating the ordering and payment processes. The platform does not bear any direct legal responsibility for any damages or losses that may result from the use or consumption of the products.
  3. If the user has any inquiries, remarks, or complaints regarding the product (such as delay, discrepancy from specifications, packaging issues, or taste), the user is responsible for contacting the concerned seller directly via the communication channels available on the platform.
  4. If the seller does not respond to the complaint or the issue is not resolved amicably, the user may escalate the complaint to the Sit Habayib support team within 48 hours of receiving the product. The platform will review the case and may intervene as a mediator to support resolution, without assuming legal liability for the outcome of such intervention.
  5. The platform allows users to rate products and sellers after receiving their orders; these ratings are used to improve service quality and promote transparency among the parties involved.

 
Perishable Products
Due to the nature of the products offered on the Sit Habayib platform, which include homemade foods and beverages, most of these products are classified as perishable goods. Therefore, please read the following details carefully:

  1. Users are not entitled to request returns, exchanges, or refunds based on a change of mind or personal dissatisfaction after receipt (such as taste or individual preferences), provided that the product:
    • Was delivered in good condition.
    • Matched the description displayed on the platform.
    • Complied with health and safety requirements.
    • Exceptions apply only to cases specified in the Return Policy below.
  2. We encourage users to carefully review the product details before confirming the order and to contact the seller via the platform if they have any inquiries regarding ingredients, preparation methods, or storage conditions.

 
Food Allergies
Sit Habayib offers homemade food products prepared by productive families, and some of these products may contain ingredients that can cause allergic reactions such as milk, eggs, wheat, nuts, peanuts, fish, shellfish, or others. Therefore, users are fully responsible for ensuring that the product is suitable for their health condition or any food allergies they may have before placing an order. Users should contact the seller if they have any concerns or questions regarding the ingredients, as Sit Habayib does not guarantee that the products are free from allergens. Accordingly, Sit Habayib disclaims all liability for any health damages resulting from consuming a product containing allergenic ingredients if the user did not verify the product’s components in advance.
Out of its humanitarian responsibility towards valued customers, the platform has established the following requirements for sellers in this regard:

  1. Each seller must provide a description for every product offered, including a list of main ingredients, especially those known to cause food allergies, such as milk, eggs, nuts and peanuts, gluten (wheat), soy, fish and shellfish, honey (for children under 12 months), and others.
  2. If ingredients are not clearly specified or allergy warnings are missing, Sit Habayib’s management reserves the right to temporarily suspend or permanently remove the product to protect consumer safety.
  3. The seller bears full direct responsibility for any harm caused by hiding or neglecting to mention ingredients that may be hazardous to certain user groups, and affected users retain the right to file an official complaint.
  4. Sit Habayib encourages all sellers to follow best practices in classifying their products and clearly stating food allergy warnings within the product description.

 
Return Policy

  1. Sit Habayib is committed to applying a fair return policy that complies with the laws and regulations in the Sultanate of Oman, especially regarding consumer rights.
  2. Payments are only refundable in specific cases according to the return policy applicable in Oman, which include the following:
    • Failure to receive the product within the agreed-upon timeframe without an acceptable justification from the seller.
    • Receiving a damaged or unfit-for-consumption product.
    • The product violating health and safety standards enforced in Oman.
    • A significant discrepancy between the product ordered via Sit Habayib and the product received (such as differences in type, quantity, or meal ingredients).
  3. Users must submit a clear and supported complaint (including photos or videos if possible) within a maximum of 24 hours from receiving the product, either through the complaints feature on the platform or by contacting the support team.
  4. The complaint will be evaluated and its details verified in cooperation with the seller. If the complaint is confirmed, one of the following actions will be taken:
    • Refund of the amount paid to the user within no more than 7 working days.
    • Or, based on an agreement with the user, sending a replacement product.
    • Return or refund requests for any reasons outside the above cases, such as user dissatisfaction with taste or expected quantity, will not be accepted unless the product is found to be inconsistent with the description displayed on the platform.

 


Cancellation Policy

  1. Cancellation Before Execution: Users may cancel their order within 30 minutes of placing it, provided the seller has not yet started processing the order. Cancellation should be done by contacting the platform’s customer service.
  2. Cancellation After Execution Has Started: Once the seller has begun processing the order, cancellation is only allowed in exceptional cases and requires approval from both the seller and the platform. Cancellation in this stage may incur administrative fees or result in a partial refund.
  3. Cancellation Due to Product Unavailability: If it is found that the product is unavailable after the order has been placed, Sit Habayib will promptly notify the user. The order will then be canceled, and the full payment will be refunded to the user.
  4. Refunds Upon Cancellation: When an order cancellation is accepted, the payment will be refunded via the original payment method within a maximum of 7 business days. Please note that actual refund processing times may vary depending on the payment provider’s procedures.
  5. Cancellation by the Seller: The seller reserves the right to cancel orders under certain circumstances, such as product unavailability or unforeseen events beyond their control. In such cases, the user will be notified immediately, and the full amount paid will be refunded without any deductions.

 


Data Protection and Privacy

  1. Sit Habayib is committed to protecting the privacy of its platform users in accordance with the provisions of the Personal Data Protection Law in the Sultanate of Oman. Personal data provided by the user, such as name, phone number, delivery address, and order details, are collected and used solely for the purposes of fulfilling orders and improving the quality of services offered. This data is stored in secure electronic systems, with all necessary technical and administrative measures taken to prevent unauthorized access.
  2. User data is not shared with any third party except when necessary to fulfill the order (such as electronic payment companies or delivery services), or when data is requested by law from competent judicial authorities in Oman. Users have the right to access, modify, or delete their personal data at any time through the platform.

 
 
 
Intellectual Property Rights

  1. All content on the Sit Habayib platform — including but not limited to texts, logos, images, graphics, designs, icons, videos, software, and the arrangement and organization of content—is the exclusive property of Sit Habayib and is protected under the applicable intellectual property laws of the Sultanate of Oman as well as relevant international agreements.
  2. No part of the platform’s content may be copied, modified, distributed, published, or reused for any purpose without prior written permission from the management of Sit Habayib. The use of the platform’s name, logo, or visual identity in any manner that may cause confusion or infringe upon the platform’s legal rights is also strictly prohibited.
  3. Any unauthorized use constitutes a clear violation of Sit Habayib’s rights and entitles the platform to take appropriate legal actions to protect its intellectual property.

 
 
 
 
Disclaimer

  1. Sit Habayib provides its services "as is" and based on availability, without any explicit or implicit warranties regarding the quality, accuracy, or reliability of the services or the products offered by the merchants registered on the platform.
  2. Sit Habayib shall not be held liable for any direct or indirect, material or moral losses or damages resulting from your use of the platform, whether due to incorrect data entry, misuse of the platform, or failure to follow usage instructions.
  3. Sit Habayib bears no responsibility for the products or services provided by the merchants, including but not limited to product quality, suitability, compliance with descriptions, or adherence to health standards. The contractual relationship remains directly between the user and the merchant, and any disputes or claims arising between them shall be handled without direct intervention or liability on Sit Habayib.
  4. Sit Habayib reserves the right to suspend or terminate any user's access to the platform in case of violation of any terms and conditions, without any obligation to provide compensation.
  5. Sit Habayib shall not be responsible for any failure or delay in payment processing through the electronic payment gateways available on the platform, if caused by technical issues with the service provider, problems with the user’s bank card, or rejection by the issuing payment entity. In cases where the amount is deducted from the user without receiving order confirmation, the user must notify the technical support team within 24 hours, attaching proof of payment. The platform will coordinate with the service provider to verify the transaction and take appropriate action. However, this does not constitute a legal obligation on Sit Habayib to guarantee a refund unless a genuine error in the platform’s payment system is proven.

 


Governing Law and Dispute Resolution

  1. These Terms and Conditions are governed by and shall be interpreted in accordance with the laws and regulations in force in the Sultanate of Oman.
  2. In the event of any dispute arising between the user and Sit Habayib regarding the interpretation or execution of any provision of this agreement, the parties shall first attempt to resolve the dispute amicably through negotiation. If amicable resolution fails, the dispute shall be referred to the competent judicial authorities in the Sultanate of Oman.
